Job description

I'm currently working with a client to find a suitable candidate for a contract (starting early Jan 2020 for 3-6 months) for Commercial / Contracts Management role based in London. The salary / rate is negotiable, depending on experience but is expected to be c. £250-300 per day outside IR35 or £40,000 - £50,000 pro-rata.

PFI experience is not essential (although desirable) but strong commercial acumen is a must, with strong contractual competence and skill-set. Please see below, a list of expected duties:

* Associated with FM Co or Constructor non-compliance with contract documents, ensuring a detailed understanding of those contracts and providing commercial support to the operational teams, including:

o Reviewing contract documentation to establish responsibility for issues disputed by the supply chain
o Provide formal responses, properly referencing contractual provisions to demonstrate obligations
o Drafting pay-less notices as necessary for recovery of relevant sums in full accordance with contract provisions for issue by the General Manager
o Leading on any formal disputes with the supply chain in accordance with contracts' Dispute Resolution Procedure.

* Establish and implement a plan to review compliance with the Project Agreements and also those specific Lender operational requirement obligations. Produce an annual programme of monthly sample testing of obligations to deliver assurance of all obligations being fully checked by the operations team over the course of each year.
* In relation to the Project Agreement penalty regime (Service Failure Points & Facility Deduction Percentages) - undertake a full review of FM Co reporting to ensure these are accurately reported to Boards with a clear view of them at each relevant period compared to the specific contract thresholds. Produce graphs / charts in MS Excel for ease of illustration within Board reports and produce guidance for the operations team on future use / population.
* Request and obtain suitable capex breakdown of costs for variations ready for pricing adds and omits associated with life-cycle replacement. Utilising internal processes, price the life-cycle associated with each variation and submit to the Strategic Asset Manager for sign off before inclusion within estimates for return to tenants.
* Undertaking any other commercial related duties as may be reasonably requested by Fulcrum
* Produce detailed handover notes and hold meetings with General & Operations managers to ensure a robust and clear handover at the end of the commission
